Welcome to Nizami Herbal. These Terms & Conditions ("Terms") govern your access to and use of our website at nizamiherbal.com(the "Site") and your purchase of products from us. By browsing the Site, creating an account, or placing an order, you agree to be bound by these Terms and our related policies.

1. About Us

Nizami Herbal sells herbal wellness and dietary supplement products across Pakistan. We formulate products using natural botanical ingredients and operate in compliance with applicable Pakistani regulations, including DRAP registration requirements where applicable.

2. Eligibility

  • You must be at least 18 years old to create an account or place an order.
  • We currently deliver within Pakistan only. International orders are not accepted.
  • You agree to provide accurate, complete, and current information during registration and checkout.

3. Health & Product Disclaimer

Our products are dietary supplements and herbal wellness products. They are not medicines and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

  • Product descriptions, blog content, and customer support guidance are for informational purposes only.
  • Individual results may vary. Always read product labels, dosage instructions, and contraindications.
  • Consult a qualified healthcare professional before use if you are pregnant, nursing, taking medication, or have a medical condition.
  • Discontinue use and seek medical advice if you experience an adverse reaction.

Nothing on this Site constitutes medical advice. Our WhatsApp helpline provides general product guidance, not clinical diagnosis or treatment.

4. Account Registration

You may browse and checkout as a guest or register for an account. When you register, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately if you suspect unauthorized access.

We may suspend or terminate accounts that violate these Terms, provide false information, or engage in fraudulent activity. You may delete your account at any time from Account Settings.

5. Orders & Order Acceptance

When you place an order through the Site:

  • You submit an offer to purchase the selected products at the displayed price.
  • Order confirmation (on-screen, via email, or WhatsApp) acknowledges receipt of your order—not final acceptance.
  • We reserve the right to cancel or refuse any order before dispatch (e.g., stock unavailability, pricing error, suspected fraud).
  • We may contact you via WhatsApp or phone to confirm delivery details before dispatch.

An order is considered accepted when it is dispatched or marked as confirmed by our team. You will receive tracking information when available.

6. Pricing, Taxes & Coupons

  • All prices are listed in Pakistani Rupees (PKR) unless stated otherwise.
  • Prices, discounts, and promotions may change without notice. The price at checkout applies to your order.
  • Applicable taxes are calculated and displayed during checkout where required.
  • Coupon codes are subject to their individual terms (minimum order value, expiry date, usage limits). We may cancel a coupon benefit if terms are violated.

7. Payment Methods

We accept the following payment methods:

  • Cash on Delivery (COD): Pay the courier in cash when your order arrives. Available nationwide.
  • PayFast: Online card, bank, and wallet payments processed through PayFast. You will be redirected to complete payment on their secure checkout.

Failed or declined online payments will not result in order fulfillment until payment is successfully received. For COD orders, refusal to accept delivery may affect your ability to place future COD orders.

8. Shipping & Delivery

Delivery is handled through our courier partners (including TCS). Full details are in our Shipping Policy. Summary:

  • Major cities: typically 2–3 business days
  • Other cities: typically 3–5 business days
  • Shipping charges: Rs. 200 standard rate; free delivery on orders of Rs. 2,000 or more

Delivery times are estimates and may be affected by weather, holidays, remote locations, or courier delays. Risk of loss passes to you upon delivery to the address you provided. Ensure your contact number is reachable for courier coordination.

9. Returns, Refunds & Replacements

Our return and refund rules are set out in the Returns & Refund Policy. By placing an order, you agree to those terms. In summary: damaged or incorrect items must be reported promptly; certain opened supplement products may not be eligible for return due to hygiene and safety regulations.

10. Product Reviews

Customers may submit product reviews on the Site. By submitting a review, you grant us a non-exclusive right to display and use your review content on the Site and in marketing materials. Reviews must be honest, based on genuine experience, and must not contain offensive, misleading, or promotional third-party content. We may remove reviews that violate these standards.

11. Intellectual Property

All content on the Site—including text, images, logos, product names, formulations descriptions, and design—is owned by or licensed to Nizami Herbal and protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.

12. Acceptable Use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of Pakistani law
  • Attempt to gain unauthorized access to our systems, accounts, or data
  • Place fraudulent orders or abuse coupon, referral, or promotional programs
  • Scrape, crawl, or automate access to the Site without permission
  • Upload malware, spam, or harmful code
  • Impersonate another person or misrepresent your affiliation with Nizami Herbal

13. Limitation of Liability

To the fullest extent permitted by law, Nizami Herbal and its owners, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or products—including loss of profits, data, or goodwill.

Our total liability for any claim related to a specific order shall not exceed the amount you paid for that order. Nothing in these Terms limits liability where it cannot be excluded under applicable law.

14. Indemnification

You agree to indemnify and hold harmless Nizami Herbal from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms, misuse of the Site, or infringement of any third-party rights.

15. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect and use personal data. By using the Site, you consent to those practices.

16. Governing Law & Disputes

These Terms are governed by the laws of the Islamic Republic of Pakistan. Any dispute arising from these Terms or your use of the Site shall first be attempted to be resolved amicably by contacting us. If unresolved, disputes shall be subject to the exclusive jurisdiction of the competent courts in Pakistan.

17. Changes to These Terms

We may update these Terms at any time. The "Last updated" date reflects the latest revision. Material changes will be posted on this page. Continued use of the Site after changes constitutes acceptance of the updated Terms.
